These terms and conditions (“Terms of Sale”) apply to all purchases of memberships and other products and services from the American Association of Private Employees and the American Association of Government Employees (“The Associations”) web site and make up part of the The Associations web site Terms of Use. If you purchase a membership or other product, service, or benefit from The Associations web site, you are deemed to have accepted The Terms of Use then in effect, including the Terms of Sale then in effect, and to agree to be bound by them.

We reserve the right to revise these Terms of Sale at any time, without notice. Any amendment will be effective immediately upon posting of the amended Terms of Sale on The Associations web site. These Terms of Sale were last updated on October 20, 2015. On purchasing a membership, product, service, or benefit from the web site, you agree to be bound by the Terms of Sale in effect as of the date of purchase.

Currency, Pricing, and Fees

All membership and other The Associations products, services, and benefits prices are stated in US Dollars (USD). All memberships are subject to the same terms and conditions.

When you make payment by either credit card or online payment, you must have the specific authority of the credit card or online payment account holder. Credit card details and payment will be processed by a third party engaged by The Associations to provide this service on the web site.  Your purchase will appear on your credit card statement as “ISM ADMIN”.

Availability

Membership in The Associations is available to any current or former employee of an American entity.

Electronic Purchase of Membership

After you purchase a new membership a New Member packet will be sent to the physical address you provided. The New Member packet includes terms and conditions of your membership and provides details about your membership and related products, services, and / or benefits. A membership may also be purchased by telephone or by submitting a hard copy of our Association Membership Application.

Order Confirmation

When you complete a purchase online, you will receive a confirmation email. If you do not receive this email then it is your responsibility to contact us to inform us. Your email address will be used to identify you. Please be sure you enter a real email address that you can access. If you do not receive a confirmation and are unable to access your email, please contact us immediately at memberservices@americanassociations.org to resolve the issue.

Cancelled and Changed Product, Service, or Benefit

The Associations reserve the right to add, withdraw, or replace any product, service or benefit, and to amend any product, service, or benefit, including effective date(s), prices, scope of coverages, and/or benefits.

Occasionally, a product, service, or benefit may be cancelled by The Associations or by a third-party provider due to extenuating circumstances, such as a change in position or current business climate, war or threat of war, riot, civil strife, terrorist activity or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, and all similar events outside The Associations’ control.

Refunds and Exchanges

Unless required by law, we do not provide refunds for any memberships, product, services, or benefits purchased. Therefore, please ensure that you carefully review your selection before processing the purchase. Any processing fees may not be refundable.

Rules and Restrictions

Certain rules and restrictions apply to some third-party provided products, services, or benefits. It is your responsibility to read the terms and conditions for every product, service, or benefit you receive or purchase. Memberships and / or third-party provided products, services, or benefits will not be refunded for failure to read the terms and conditions.

Reselling and Reproduction Policy

No membership, product, service, or benefit may be resold or reproduced. The Associations reserve the right to cancel such memberships, and refuse access to products, services, and / or benefits to any member who has purchased a membership and resold or reproduced it, or to any person attempting to use a resold or reproduced membership.

LIMITATION OF LIABILITY

THE MEMBER VOLUNTARILY ASSUMES ALL RISK AND DANGER INCIDENTAL TO MEMBERSHIP, INCLUDING ANY DEATH, PERSONAL INJURY, LOSS, DAMAGE, OR LIABILITY.

BY PURCHASING A MEMBERSHIP, PRODUCT, SERVICE, AND / OR BENEFIT ON BEHALF OF OTHERS, INCLUDING MINORS, YOU ACKNOWLEDGE THAT THOSE PARTIES ARE AWARE OF ALL TERMS AND CONDITIONS RELATING TO THEIR MEMBERSHIP, PRODUCT, SERVICE, OR BENEFIT.

YOU AGREE TO RELEASE AND INDEMNIFY THE ASSOCIATIONS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM ALL RESPONSIBILITY AND LIABILITY IN RELATION TO MEMBERSHIP.  YOU FURTHER AGREE THAT THE ASSSOCIATIONS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, INJURY, OR DAMAGE (“DAMAGES”) HOWEVER CAUSED, WHETHER TO ANY PERSON OR PROPERTY, INCLUDING UNDER CONTRACT, TORT, STATUTE, PRODUCT LIABILITY, OR OTHERWISE, WHETHER THE DAMAGES BE DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL, RESULTING FROM THE USE OF THIS WEBSITE, YOUR USE OF OR INABILITY TO USE THE MEMBERSHIP, PRODUCT, SERVICE, OR BENEFIT, THE CANCELLATION OR CHANGE OF THE MEMBERSHIP, PRODUCT, SERVICE, OR BENEFIT, OR FOR ANY OTHER REASON WHATSOEVER.
